The Concord Police Department wants to remind residents that firing a gun into the air is not the way to ring in the New Year.

The definition of celebratory gunfire is the shooting of a firearm into the air in celebration.

Law prohibits discharging a firearm into the air, and if caught, violators will be arrested and prosecuted to the fullest extent of the law, according to a statement from the Concord Police Department.

"It's been a tradition for as long as I can remember," Concord Police Department spokeswoman Capt. Betty Crump said. " It's important that everyone is aware of the potential dangers."

The Concord Police explain that city code prohibits any person to shoot or discharge any gun, pistol or other firearm, BB gun, air compression gun, spring gun or other similar device which propels with force a shot, pellet or other projectile within municipal limits.

The same code also states that any person in violation could be fined $500, imprisoned 30 days or both. Also, violators may be charged under North Carolina General Statues.

There were nine cases of reported gunfire on New Year's Eve 2007, with 13 reported gunfire calls on New Year's Day 2008.

On New Year's Eve 2008, Concord Police Department received two gunfire calls and six gunfire calls on New Year's Day.

Crump said people engaging in celebratory gunfire do not always understand or realize the danger posed by firing a bullet into the air. Celebratory gunfire can cause damage to homes and businesses, injure people and pets, and have the potential to be fatal.

People who decide to celebrate in this manner will face criminal prosecution and possibly be responsible for civil penalties.

Police recognize the diversity in the community and wants to be sure everyone understands the dangers, Crump said.

Concord Police wants all citizens celebrate the New Year responsibly and safely.

They ask to please refrain from shooting any firearms into the air and that if you know of anyone planning to celebrate this way, notify the police at 704-920-5580 or 911.
